Terms & Conditions

Welcome to Petit Verbier. These Terms & Conditions define the framework of legal expectations, responsibilities, and protocols governing client engagements with our elite child guardianship and seasonal support services. By requesting, contracting, or utilizing the services provided by Petit Verbier Legal, you enter a binding contractual relationship and agree in full to the terms detailed herein. Please review these operational protocols carefully.

Section 1: Day Time Childcare

1.1 Session Confirmation: Day time childcare reservations are considered fully secured only upon receipt of a digital confirmation receipt issued by the Agency’s corporate dispatch and after verification of the corresponding retainer payment.

1.2 Minimum Reservation Duration: Routine day time sessions demand a minimum booking block of four (4) consecutive hours per caregiver. Split shifts requested within a single calendar day are subject to custom approval and additional transport premiums.
1.3 Standard Daytime Hours: Daytime tariffs apply to services delivered strictly between the hours of 08:00 and 18:00. Any portion of service extending beyond the standard 18:00 threshold will automatically transition to our Evening/Overtime Rate schedule.
1.4 Notification & Cancellation Penalties: Cancellation of standard daytime childcare must be formalized in writing at least 72 hours before the scheduled service start. Cancellations made between 72 hours and 24 hours will incur a 50% penalty. Cancellations under 24 hours are non-refundable and will be billed at full contract value.
1.5 Health Disclosure Requirements: Parents or designated legal guardians must comprehensively declare all known health issues, therapeutic guidelines, allergy profiles, and dietary restrictions in writing before our personnel assume care. The Agency reserves the right to decline or suspend care in the absence of precise, complete medical disclosures.

SECTION 2: EVENING BABYSITTING

Operational guidelines and standards governing evening assignments (clauses 2.1 to 2.5).
2.1 Commencement & Hours: Evening babysitting services typically commence from 19:00 onwards unless otherwise agreed in writing. The client agrees to provide clear instructions regarding bedtime routines, emergency contacts, and household safety rules.

2.2 Minimum Booking: A minimum booking of three (3) consecutive hours applies to all evening engagements. Hourly rates are billed in accordance with the standard rate card provided upon registration.

2.3 Transport & Late Hours: If the babysitting assignment extends past midnight (00:00), the client is responsible for providing safe transport home or fully reimbursing taxi fares for the babysitter to ensure their safe return.

2.4 Conduct & Safety: The babysitter is strictly prohibited from hosting guests, consuming alcohol, or leaving the premises at any point during the active evening assignment.

2.5 Cancellation Policy: Cancellations made within 24 hours of the scheduled start time will incur a cancellation charge equal to 50% of the estimated booking total.

SECTION 3: INTRODUCTORY MEETING

Establishing trust, mutual alignment, and child-caregiver compatibility prior to placement.
3.1 Pre-Placement Consultation: To ensure the highest standard of care and absolute compatibility, Petit Verbier highly recommends a brief introductory meeting between the family and the assigned childcare professional prior to the first official placement.

3.2 Consultation Rates: This initial consultation is charged at a flat introductory rate. If the family proceeds with an active booking package within 14 days of this meeting, this fee will be fully credited towards their first placement invoice.

SECTION 4: SETTLING IN

Fostering a gentle and comforting transition for your children into our care.
4.1 Hand-Over Protocol: We recognize that settling into a new environment with a new caregiver requires transition time. Parents are highly encouraged to allocate 15 to 30 minutes at the start of the first session to facilitate a comprehensive hand-over with the practitioner.

4.2 Routine Mirroring: During the settling-in period, the caregiver will work closely with the parents to align and mirror established daily routines, comforting techniques, sleeping habits, and specific dietary preferences.

4.3 Progressive Separation: If the child exhibits high levels of separation distress, a progressive separation plan may be mutually established between the family and the coordinator to ensure the child feels entirely secure.

Section 5: HEALTH AND SAFETY

Petit Verbier prioritizes the physical well-being of your children. All active nannies and caregivers hold valid, internationally recognized Pediatric First Aid certifications and undergo comprehensive seasonal safety briefings specific to alpine environments, winter hazards, and high-altitude health considerations.
5.1 Emergency Medical Authorization
In the event of an emergency, illness, or accident requiring immediate medical intervention, Petit Verbier staff will make every effort to contact the parents or designated emergency contacts immediately. If parents cannot be reached, you hereby authorize Petit Verbier to consent to emergency medical treatment, including but not limited to first aid, ambulance transport, and evaluation by qualified Swiss medical professionals.
5.2 Medication Policy
Nannies will only administer prescribed or over-the-counter medication upon explicit, written instruction from a parent or guardian. All medications must be supplied in their original packaging, clearly labeled with the child’s name, dosage instructions, and expiration date. Under no circumstances will a caregiver administer medication outside these parameters.
5.3 Illness & Exclusion Policy
To maintain a safe environment for all children and staff, children suffering from contagious illnesses (including but not limited to fevers above 38°C, active vomiting, diarrhea, or infectious rashes) cannot be accepted for care. Children must be symptom-free for a minimum of 48 hours before resuming care with Petit Verbier. If a child becomes ill during a booking, parents will be notified and are required to arrange collection as soon as possible.

Section 6: CHILD PROTECTION

Petit Verbier is strongly committed to safeguarding and promoting the welfare of children and young people. We expect all staff, partners, and parents to share this absolute commitment. Our child protection policies strictly align with Swiss federal regulations and Valais cantonal child safety guidelines.
6.1 Background and Screening Checks
Every employee at Petit Verbier undergoes rigorous screening procedures prior to employment. This includes comprehensive identity verification, international criminal record checks (including specialized police checks for working with children), professional reference checks, and detailed in-person interviews to assess psychological suitability and care competence.
6.2 Duty of Care and Reporting Protocol
Our caregivers have a legal and moral duty of care to report any signs of physical abuse, emotional abuse, neglect, or harm. If a caregiver suspects a child in their care is undergoing abuse or neglect, they are trained to document their observations objectively and report immediately to the Petit Verbier management, who will escalate the matter to local Swiss child protection authorities (Service de protection de la jeunesse) as legally mandated.

Section 7: FOOD

Nutrition plays an essential role in keeping children active and happy, especially during energy-demanding mountain days. We prioritize providing balanced, wholesome options and respecting personal dietary choices and medical restrictions.
7.1 Allergy Declaration & Dietary Requirements
Parents must explicitly list all known food allergies, intolerances, and severe dietary restrictions during the booking registration process. If a child has a history of anaphylaxis, parents are required to provide a valid, in-date epinephrine auto-injector (EpiPen) and instruct the agency and assigned nanny on its specific administration protocol prior to the first care session.
7.2 Meal Provision & Safety
Unless alternative arrangements are explicitly made, parents are responsible for supplying necessary meals, snacks, and formula for their children. If Petit Verbier is contracted to prepare or purchase food, we adhere to strict hygiene and cross-contamination prevention standards. No high-risk foods containing nuts will be introduced or shared in group environments to prevent accidental exposure.
Please review sections 1 through 4 for general terms of booking, liability limitations, and payment conditions. By executing a booking with Petit Verbier, you agree to all terms stated within this multi-part legal policy document.
Petit Verbier Legal Framework

Section 8: Your Child’s Belongings

8.1 Loss and Damage Disclaimer
Petit Verbier accepts no liability or responsibility for the loss, damage, or theft of any personal belongings, clothing, gear, or electronic equipment brought by your child to our activities, lessons, or childcare sessions. All items are brought entirely at the owner’s own risk.

8.2 Obligatory Labeling
To facilitate the return of lost property and prevent confusion, parents and guardians are strictly required to ensure that all personal belongings—including ski equipment, boots, helmets, gloves, goggles, goggles cases, and spare outerwear—are clearly and permanently labeled with the child’s full name.

8.3 Restricted High-Value Items
We highly recommend that children do not bring valuable personal items, such as mobile phones, tablets, handheld gaming consoles, jewelry, expensive watches, or large sums of money. Petit Verbier staff are not responsible for safeguarding these items and will not compensate for their loss.

Section 9: Equipment Rental

9.1 Custody and Responsibility
All equipment rented directly through Petit Verbier, or arranged on the client’s behalf with our recommended local rental partners, remains under the sole custody and responsibility of the client during the entire rental period specified in the booking confirmation.

9.2 Damage and Loss Indemnity
The client agrees to return all rented gear in the same condition as received, normal wear and tear excepted. In the event of severe damage, breakage, loss, or theft, the client agrees to fully reimburse Petit Verbier or the respective rental provider for the necessary repair or full replacement retail value of the items.

9.3 Timely Returns & Late Charges
Rented equipment must be returned to the agreed drop-off point or made available for our team’s collection at or before the designated return hour. Failure to return equipment on time may trigger automated daily extension rates and late handling surcharges.

9.4 Fit and Technical Safety Compliance
It is the absolute responsibility of the parent or guardian to ensure that all rented equipment—particularly ski boot fittings, safety helmet sizing, and ski binding DIN release adjustments—is custom-fitted and approved by a certified sports equipment technician before the child commences any physical activities.

Legal Framework & Service Directives

Part 5 of 5: Liability frameworks, staff solicitation policies, client data privacy guidelines, termination clauses, and jurisdiction standards.

10. Limitation of Liability

10.1 Intermediary Status: Petit Verbier acts solely as an introductory and placement intermediary between the Client and independent, self-employed childcare providers. While the agency carries out rigorous background screening, certification audits, and reference checks, under no circumstances shall Petit Verbier be held liable for any direct, indirect, incidental, or consequential damages, emotional distress, physical injury, or loss of property resulting from the actions, omissions, negligence, or professional services rendered by the engaged childcare provider.

10.2 Household Responsibility: The Client acknowledges that once the childcare service begins, the provider operates under the general instruction of the Client. The Client remains solely responsible for ensuring a secure domestic setting and keeping in force appropriate household, public liability, and domestic employment insurances (such as LAA or equivalent Swiss/international casualty protections) for the duration of the engagement.

10.3 Cap on Liability: In any event where Petit Verbier is legally determined to bear direct liability, the agency’s maximum collective liability to the Client for any claim, cost, damages, or legal expenses shall never exceed the total cumulative agency booking fees actually paid by the Client in the three (3) months preceding the incident.

11. Employing or Engaging Petit Verbier Staff

11.1 Non-Solicitation Covenant: The Client strictly agrees not to recruit, employ, hire, or contract, either directly or indirectly, any nanny, babysitter, or staff member introduced or placed by Petit Verbier for private childcare or household duties outside the direct billing and coordination framework of the agency, unless prior formal written authorization is granted by the directors of Petit Verbier.

11.2 Duration of Restriction: This non-solicitation and engagement restriction remains fully active throughout the entire active lifecycle of the client’s agency agreement and extends for a strict period of twelve (12) calendar months following the date of termination or the candidate’s last official assignment with the Client.

11.3 Liquidated Damages & Finder’s Fees: In the event of a breach of this non-solicitation covenant, the Client shall be legally liable to pay Petit Verbier a direct, standard placement and finder’s fee. This fee is calculated as either twenty percent (20%) of the candidate’s projected or actual gross annual salary or a flat rate of CHF 5,000 (whichever value is greater). This sum shall be immediately due and payable upon the issuance of the invoice by Petit Verbier.

12. Data Protection

12.1 Compliance Standards: Petit Verbier operates in strict accordance with the Swiss Federal Act on Data Protection (FADP) and complies with global personal data principles, including the General Data Protection Regulation (GDPR) guidelines. Client records, booking information, household addresses, and private contact profiles are processed solely for placement, safety orchestration, and administrative functions.

12.2 Sharing of Information: The Client consents to the sharing of essential operational details (such as medical conditions of minors, allergy logs, local contact numbers, and address directions) with assigned nannies solely on a necessary-to-know basis. Petit Verbier will never sell, lease, or distribute private client records to unauthorized third parties or marketing platforms.

12.3 Candidate Data Confidentiality: The Client acknowledges reciprocal responsibilities and must maintain complete confidentiality regarding all candidate profiles, personal histories, resumes, and video presentations shared by Petit Verbier. Candidate information must not be forwarded, reproduced, or stored outside the personal security context of the immediate assignment.

13. Termination

13.1 Written Notice: Either party may formally dissolve this relationship by providing the other party with at least seven (7) business days of written notice. Any bookings already scheduled during this seven-day period must be settled in full, subject to the agency’s existing cancellation fee schedule.

13.2 Material Breach: Petit Verbier reserves the right to suspend or terminate services immediately, without notice, if the Client commits a material breach of terms, exhibits fraudulent behavior, or fails to clear any overdue invoice balance within the specified timeline.

13.3 Safety Precautions: If an assigned nanny or agency staff member experiences a domestic working environment that is deemed hostile, verbally or physically unsafe, or violates basic labor protections, Petit Verbier reserves the absolute right to pull staff immediately and terminate all agreements without refunding active placement administrative fees.

14. Miscellaneous

14.1 Severability: If any single provision, sub-clause, or phrase within these Terms is deemed illegal, unenforceable, or invalid by a court of competent jurisdiction, that judgment shall not disrupt the validity, legality, or binding status of any remaining sections, which shall continue to enforce full performance.

14.2 Entirety: These unified terms constitute the definitive agreement between the Client and Petit Verbier and fully supersede all preceding written proposals, verbal agreements, email exchanges, or representations concerning our childcare and agency placement structures.

14.3 Jurisdiction & Venue: This Agreement shall be governed, parsed, and interpreted strictly under the laws of Switzerland. The exclusive venue of jurisdiction for resolving any contractual disputes, legal action, or claims arising from our operations shall be the courts of Valais, Switzerland.
